User Agreement

This “User Agreement” constitutes an offer by LLC “ECU COMPANY” to conclude a contract under the terms set forth below.

I. General Provisions

  1. LLC “ECU COMPANY” (hereinafter referred to as “Ecu company”) offers Internet users (hereinafter referred to as “User”) access to its services under the terms of this User Agreement (hereinafter referred to as the “Agreement” or “User Agreement”). This Agreement enters into force upon the User’s express consent to its terms in accordance with Clause 4 of this Agreement.
  2. Ecu company provides users with access to its services, including uploading, analyzing, and modifying files. All currently available services as well as any development or addition of new services are governed by this Agreement.
  3. The use of Ecu company’s services is regulated by this Agreement, the Privacy Policy, and any applicable service-specific terms of use. Ecu company may amend this Agreement without prior notice. The revised Agreement shall come into effect upon its publication online at the address specified in this clause unless otherwise stated in the new version.
  4. By starting to use any services or specific features, or by completing the registration process, the User is deemed to have fully accepted the terms of this Agreement without any limitations or exceptions. If the User disagrees with any provision of this Agreement, they must refrain from using Ecu company’s services. If Ecu company amends this Agreement in accordance with Clause 3, and the User does not agree with the changes, the User must cease using all Ecu company services.

II. User Registration. User Account.

  1. To use certain services or specific service features, the User must complete registration and create a unique user account.
  2. During registration, the User must provide valid and complete information as requested in the registration form and must keep this information up to date. If the User provides invalid information or if Ecu company has grounds to believe the information is incomplete or false, Ecu company reserves the right to block or delete the account or restrict the User’s access to certain services (or features) at its discretion.
  3. During registration, the User must provide only their own personal data. Ecu company reserves the right to verify the provided information and request supporting documents. Failure to provide such documents may, at the discretion of Ecu company, be considered as providing false information and may result in consequences as outlined in Clause 6 of this document. If the information in the submitted documents does not match the registration details, or if the provided registration details do not allow the User to be identified, Ecu company reserves the right to deny access to the account and its services.
  4. Any personal data contained in the User’s account will be stored and processed by Ecu company in accordance with the Privacy Policy.

III. Access Credentials to the User Account

  1. Upon registration, the User must provide a valid email address (used as the login) and a password to access their account. Ecu company may prohibit the use of certain logins and impose requirements on login and password formatting (length, allowed characters, etc.).
  2. The User is responsible for the security of their login credentials and maintaining their confidentiality. The User is fully responsible for all actions (and their consequences) performed in Ecu company’s services through their account, including voluntary sharing of access details with third parties (under any agreement or contract). Any activity performed through the User’s account will be considered carried out by the User unless the User notifies Ecu company of unauthorized access or any breach (or suspected breach) of access credentials in accordance with Clause 11.
  3. The User must immediately notify Ecu company of any unauthorized (not permitted by the User) access to their account and/or any breach (or suspected breach) of the confidentiality of their credentials. For security reasons, the User must log out properly after each session using Ecu company services (by clicking “logout”). Ecu company is not responsible for any loss or damage of information or any other consequences resulting from the User’s failure to comply with this clause.

IV. User Account Usage

  1. The User may not reproduce, copy, duplicate, sell, resell, or use for commercial purposes any parts of Ecu company services (including content accessible through the services) or access to the services, unless such use is expressly permitted in the user agreement for the respective service.
  2. Certain categories of user accounts may limit or disable access to specific Ecu company services or some of their features if required under the registration terms or other applicable service-specific terms.

V. Account

  1. Ecu company may block or delete a user’s account, deny access through any account to certain Ecu company services, and delete any content without explanation, including if the User violates this Agreement or any of the documents listed in Clause 3, or if the company’s specialists detect suspicious activity related to Ecu company or its content, or in case of refusal to use the service.
  2. The User may delete their account in all Ecu company services at any time, or if such an option is available, terminate their account for specific services. To delete an account, the user must send a request to customer support at: ecu.company.com@gmail.com

VI. General Terms of Use and Storage

  1. Ecu company may impose usage limits on all users or specific categories of users (depending on user location, language of the service, etc.), including: availability/unavailability of certain service functions, retention periods for tasks or files and other content, maximum number of tasks or files per registered user, maximum file size or disk space, maximum number of service uses within a certain period, maximum content retention time, specific parameters for uploaded content, etc. Ecu company may prohibit automated requests to its servers and stop accepting any automatically generated information.
  2. Ecu company may send informational messages to its users.

VII. User Content

  1. The User is responsible for ensuring that any content they upload complies with applicable legal requirements, including liability to third parties if the content or its subject infringes on the rights and legal interests of third parties, including moral rights of authors, intellectual property rights, or any other intangible assets.
  2. The User acknowledges and agrees that Ecu company may use User Content at its discretion and may modify it to meet technical requirements of specific services.

VIII. Terms of Using Ecu company Services

  1. The User is responsible to third parties for all actions related to the use of Ecu company services, including actions that infringe on third-party rights or violate applicable laws.
  2. After using Ecu company services, the User must not: violate the rights of others, including minors, or cause harm in any way; impersonate another person or representative of an organization without permission; engage in activities that violate any restrictions imposed by this Agreement; or break any applicable laws, including international law.
  3. Ecu company will process files submitted by the User to perform specific tasks (hereinafter referred to as “Task Processing”).
  4. When purchasing the offline version of Ecu company’s services, the User is required to purchase a software license at the price specified in the price list.

IX. Rights to Services and Content

  1. All elements accessible via Ecu company services, including design elements, ECU files, text, graphics, illustrations, videos, software, databases, and other materials (“Service Content”), as well as all content posted in the services, are the exclusive property of Ecu company.

X. Liability of the Parties

  1. The User uses Ecu company services at their own discretion. Services are provided “as is.” Ecu company is not responsible for their fitness for any particular purpose.
  2. Ecu company does not guarantee that the services will meet the User’s expectations; be uninterrupted, timely, secure, or error-free; provide reliable or accurate results; or that any products, services, or information obtained will meet the User’s expectations.
  3. Any materials (including ECU files, downloadable software, messages, instructions, etc.) obtained via the services are used at the User’s own risk. The User is responsible for any consequences, including damage to their computer, vehicle, or other property.
  4. Ecu company is not liable for any losses resulting from the use of its services or individual features.
  5. If the User has complaints about service quality, they must contact customer support via email at ecu.company.com@gmail.com

XI. Disputes and Claims

  1. Refunds are subject to the conditions outlined in Clauses 30–34.
  2. The maximum period to submit a claim regarding file processing quality is 14 days (excluding the offline version of the software, which is non-refundable once installed). This period starts from the time of payment and applies to each task separately.
  3. Claims must be submitted from the User’s account email address to ecu.company.com@gmail.com. Claims sent from other addresses will not be considered.
  4. The User must provide detailed information about the problem, including a description, photos, screenshots, and any supporting evidence. Additional information may be requested.
  5. The User agrees that Ecu company has the primary right to fix the processing issue before any refund is considered. The User must wait for resolution or confirmation that the issue cannot be fixed.
  6. If Ecu company confirms the issue, it will notify the User by email.

XII. Other Provisions

  1. If any provision is found invalid or unenforceable, the remaining provisions remain valid and enforceable.
  2. This Agreement constitutes the entire agreement between the User and Ecu company regarding service usage and supersedes all prior agreements.
  3. Nothing in this Agreement shall be interpreted as creating an agency, partnership, employment, or joint venture relationship.
